General Terms and Conditions
of the Holiday Hotel and Travel Service "Forelle" GmbH
§ 1: Scope of Application
The following terms and conditions apply to the provision of accommodation services and all other services provided by the hotel. Only these terms and conditions shall apply. Any general terms and conditions of the customer shall only apply in addition to these conditions if the parties expressly agree to this in writing. In case of conflicts between the customer's terms and conditions and these conditions, the latter shall always prevail.
§ 2: Contractual Relationship
The contract with the customer is concluded upon confirmation by the hotel. In the case of reservations made by a third party, this third party expressly undertakes to be liable for performance alongside the customer, regardless of any effective authorization of the customer. The representative is therefore jointly and severally liable with the customer for the obligations arising from this contract.
§ 3: Prices
Reservations confirmed by the hotel are subject to the following cancellation deadlines:
The guest is liable to the hotel for damages or losses that occur during the term of the contract, provided that the hotel is not responsible for the damage. The guest is not liable for damages or losses if the damage is caused by a third party.

§ 3: Prices
- Prices are determined based on the valid price list at the time of reservation. All prices include the statutory value-added tax, with any increase after conclusion of the contract being borne by the customer. If more than four months elapse between the order confirmation and the provision of services by the hotel, the hotel is entitled to make price changes. If the hotel makes use of a price change, it will inform the customer immediately.
- Prices subject to change. All prices are non-binding.
Reservations confirmed by the hotel are subject to the following cancellation deadlines:
- Reservations by tour operators are generally subject to a cancellation deadline of 30 calendar days before the start of the service.
- For reservations by individuals for up to three rooms, the cancellation deadline is 14 calendar days before arrival.
- The agreed price for services provided must be paid to the hotel on the day of departure.
- A different method of payment requires an explicit agreement. This applies in particular to payment based on an invoice from the hotel. Invoices have a payment deadline of 14 days from the invoice date.
- The hotelier is also entitled to demand a reasonable deposit of 15% of the agreed price as an advance payment after the conclusion of the contract. The deposit will be credited towards the invoice amount.
- If the customer or tour operator cancels the contract after the expiry of the cancellation deadline specified in § 4, the hotel - to the extent that re-renting of the booked rooms was not possible - can request reimbursement of its expenses in accordance with the following provisions:
- Up to 7 days before the start of the service, the customer must pay 30% of the agreed room price, and from the 7th day before the start of the service, 80% of the agreed room price. The latter also applies if the customer does not accept the offered service without prior notice. This does not apply if the actual expenses incurred are lower.
- Firmly booked rooms are available to the customer from 2 p.m. on the day of arrival and must be vacated by 11 a.m. on the day of departure at the latest. Changes are only possible in agreement with the management.
- The hotel has the right to allocate firmly booked rooms to other guests after 6 p.m., unless a later arrival time has been expressly agreed. In this case, the customer cannot claim any services. However, the hotel will make every effort to accommodate the customer's wishes if the delayed arrival is not the customer's fault.
- The hotel is liable for any defects and disruptions in the services offered and will endeavor to remedy them promptly after becoming aware of them.
- Offsetting or reduction is only permissible for the customer in the case of undisputed or legally established counterclaims. The limitation period for all customer claims is six months from the termination of the contract. This limitation of liability and short limitation period also apply in favor of the hotel in case of violations of obligations during contract negotiations and positive contract violations; the statutory limitation periods apply to unlawful acts.
- The customer is provided with a parking space in the hotel's own parking lot free of charge. However, this does not constitute a contract of safekeeping. The hotel expressly points out that it does not conduct any surveillance and is only liable for damage to the vehicle that it is responsible for.
- The hotel endeavors to handle and forward specific messages, mail, or parcels for the customer with care. The hotel takes over storage, delivery, and, upon request, forwarding for a fee. Items left behind by the customer will be forwarded upon request and at the customer's expense. The hotel keeps the items for up to three months. Any liability of the hotel is excluded.
- If the provision of services by the hotel becomes impossible due to force majeure or for reasons beyond its control, it can withdraw from the contract without the customer being entitled to compensation. For the same reason, the customer can also withdraw from the contract. However, the customer must reimburse the hotel for the actual expenses incurred.
- Valuables can be deposited in the hotel safe. The safes in the hotel rooms are insured for €1500.00.
The guest is liable to the hotel for damages or losses that occur during the term of the contract, provided that the hotel is not responsible for the damage. The guest is not liable for damages or losses if the damage is caused by a third party.
§ 10: Special Notes for Events
- The organizer must obtain official permits for the conduct of the event in a timely manner and at their own expense.
- Newspaper advertisements, advertising, publications that refer to the hotel generally require the written consent of the management.
- Food and beverages may generally not be brought to events. In special cases, a written agreement must be reached.
- If the hotel procures technical and other facilities from third parties on behalf of the customer, it acts in the name and for the account of the customer. The customer is liable for the proper treatment and return of the facilities and indemnifies the hotel from all third-party claims.
- The placement of decoration materials and other items is only permitted with the consent of the hotel, taking into account local fire safety requirements. The deadline for collecting these items is 12 hours after the end of the event. A reasonable fee will be charged for any storage.
- Place of performance and jurisdiction for both parties, to the extent permitted, is the location of the hotel.
- Deviating agreements or amendments require written form. If individual provisions of the contract are ineffective, this does not affect the effectiveness of the remaining provisions. Any ineffective provisions are to be replaced in such a way that the intended purpose of the ineffective provision is achieved in a legally permissible manner as effectively as possible.
